Terms and Conditions
Please take the time to read and understand the terms and conditions set out below prior to booking with us.
1. THE AGREEMENT
All bookings are made with Stone of Arc (ABN 607 177 32 665). To attend one of our courses you are required to have read and accepted these Terms and Conditions.
Dates and prices are valid from 1st July 2020. All prices are in Australian dollars and exclude GST. All prices and conditions are subject to change without notice.
3. THINGS YOU SHOULD KNOW
All our courses require active participation. However, no one will be required to work beyond their capability. The maximum group size for each course is limited to 10 participants. Although all reasonable steps are taken to protect property, we accept no responsibility for lost, stolen or damaged property during an event.
4. BOOKING CONFIRMATION
Bookings are confirmed on receipt of total payment and acceptance of the Booking Conditions. You will receive a receipt of payment with your booking confirmation.

A Merchant Levy surcharge may be applied to credit card payments in accordance with current bank charges.
5. CANCELLATION BY YOU
The following cancellation fees will apply should you wish to withdraw your attendance for any reason.
45+ days prior to the course – Postponement offered, or 100% refund granted
30 -45 days prior to course – Postponement offered, or 90% refund granted
14 - 29 days prior to course event – Postponement offered, or 50% refund granted
0 -13 days prior to course event – Postponement offered; no refund granted
6. CANCELLATION BY STONE OF ARC
At times Stone of Arc may have to cancel a course. If this occurs every effort will be made to offer a suitable alternative. If the alternative is not suitable, we will refund your payment in full. Stone of Arc reserves the right to cancel or reschedule a course if group numbers are insufficient.
In circumstances where the cancellation is due to external factors beyond our control, any potential refund will be less any unrecoverable cost which we may have been incurred.
Stone of Arc understands the importance of protecting your privacy. Any information we collect from you will only be used for purposes associated with delivering our courses.
8. HEALTH AND MEDICAL REQUIREMENTS
All Stone of Arc Instructors have First Aid certification and a first aid kit will be available on site. Work Health and Safety is an essential element of all our courses.
It is your responsibility to declare any relevant known medical condition(s), accessibility issues or medication cold storage requirements at the time of booking.
9. DIETARY REQUIREMENTS AND FOOD ALLERGIES
If you have any food allergies or specific dietary needs, please inform us of these requirements and we will advise you if they can be catered for. In any instance where we are unable to cater for a specific requirement we will advise you to provide your own supplementary food/ snacks.
10. ACCEPTANCE OF RISK
Australia has many dangerous creatures, extreme weather conditions and uneven terrain, so working outside may increase your personal risk of exposure to these dangers.
Working with stone within a group also creates risk, and although participant safety is our number one priority (and a component of all our courses) all participants taking part in our courses do so at their own risk and no responsibility can be accepted by Stone of Arc for any loss, injury or accident.
Participants are responsible for any additional costs involved should such instances occur.
All participants will be required to:
- truthfully advise Stone of Arc of any medical reason why they should not participate in the activity;
- follow instructions given by Stone of Arc staff;
- use the safety equipment provided;
- always comply with onsite safety requirements;
- ask for help if required;
- not engage in any risky behaviour.
11. LIMITATION OF LIABILITY
To the extent permitted by law, you agree to release, discharge and hold harmless
- Stone of Arc and its employees and volunteers.
- All persons or corporations associated directly or indirectly with the conduct of the activities, from all claims, demands and proceedings however arising and indemnify them against all liability, including liability caused by their negligence and/or the negligence of others, for all injury, loss or damage arising out of or in connection with your participation in the activities.
- This release and indemnity continues forever and binds your heirs, executors, personal representative and assigns.
To assist with high level safety, participant comfort, and expansive learning outcomes, all participants must always adhere to the instructions of the qualified trainer.
13. PHOTOS AND MARKETING
You consent to us using images of you taken during the course for advertising and other promotional purposes in any medium as we require. You agree that the use of these images is without recourse to you and without compensation to you, unless a specific opt out is requested.
If you have any feedback regarding the facilitation of the course please inform your Instructor at the time so they can try to rectify the issue. All participants will be invited to provide feedback on completion of a course. If after this time you wish to provide us with any further feedback, please put your concerns, complaints or compliments in writing and send them to email@example.com.
15. APPLICABLE LAW
The state laws of NSW govern these terms and conditions. Any disputes in connection with the delivery of a Stone of Arc course, or these terms and conditions must be initiated in the courts of NSW, Australia.
